Asunción de Riesgo, Deslinde de responsabilidad y Garantía
Toda persona que decida contratar una excursión con South Trekking Travel ® EVT Leg 12092, declara conocer en toda su extensión las características y riesgos propios de las actividades a realizarse. Los participantes en cualquier actividad de turismo aventura incluyendo los paseos a caballo o cabalgatas, son personas activas y consecuentemente son candidatos a lastimarse inesperadamente, deslindando de responsabilidad a “South Trekking Travel ® EVT Leg 12092”, y al guía responsable a cargo de la excursión, por los accidentes que pudiesen producirse durante la realización de las mismas. Así mismo, heridas o daños que se ocasionen en su persona o bienes y/o sobre terceros, tanto por causas personales, ajenas, factores climáticos, fenómenos sísmicos, disturbios sociales, enfermedades, casos fortuitos o fuerza mayor; así también cuando cualquiera de las causas citadas impidiesen el normal desenvolvimiento del servicio contratado, el operador se reserva el derecho de alterar el orden del recorrido o reemplazar circuitos. También declara conocer y aceptar que las instalaciones médico asistenciales no estarán rápidamente disponibles durante, parte o todo el tiempo que dure la excursión, en virtud de realizarse la misma en espacios naturales distantes de los centros urbanos. La contratación del servicio o viaje no incluye ningún tipo de seguro o asistencia personal, y tampoco gastos de rescate o evacuación, haciendo responsable de estos gastos al abajo firmante quien obligatoriamente deberá contratar un seguro previo a la excursión. En consecuencia, por la presente, quien contrate algún servicio con South Trekking Travel ® EVT Leg 12092, renuncia a entablar cualquier tipo de reclamo judicial o extrajudicial por los motivos precedentes.
Menores: los menores de 18 años podrán realizar las actividades acompañados por un mayor responsable, el mismo que firme este documento, quien reconoce los riesgos que la actividad implica asumiéndolos con total responsabilidad y haciéndose cargo de cualquier tipo de accidente, daño o eventualidad que pudiera ocurrir. Nota: La aceptación del programa del viaje supone la adhesión total a todas las cláusulas de estas condiciones generales.
Risks taken, waiver and guaranty
Any individual booking a tour with South Trekking Travel ® EVT Leg 12092 shall understand the characteristics and risks involved in the activities to be conducted. Individuals participating in any adventure tourism-related activity, including all kind of horse treks, are active people and therefore likely to get hurt unexpectedly. Neither South Trekking Travel ® EVT Leg 12092 nor the guide responsible for the tour will be held liable in case of accidents which might take place during said activities or for injuries or damages to either individuals or goods and/or third parties both due to personal or external reasons, weather conditions, seismic movements, social riots, disease, Acts of God (force majeure) or when because of any of the above the service booked could not be conducted. The operator has the right to change the order of the tour activities or tour circuits. Any individual participating in these activities shall also understand medical help will not be available presently during a part of or the whole tour, since tours take place in areas far from urban centers. The service does not include neither personal insurance, nor evacuation and rescue costs: the person signing this document is responsible for the costs and must have an insurance before the beginning of the service with Trekking Travel. Consequently, any individual booking the services of South Trekking Travel ® EVT Leg 12092, waives the right to start any legal or out-of-court action or claim due to the reasons above mentioned. Minors: people under 18 years of age will be able to participate in the activities mentioned only if accompanied by an adult, who will also have to sign this document, understands the risks involved, and will bear the costs involved in case of accident, damage or unexpected events. Note: acceptance of the tour description implies complete fulfillment of the clauses here in.
